Terms of Service

1. The Service

GrowMyGMB is provided by Let's Advertize ("we", "us", "our"). The Service is an online platform that enables businesses to manage their Google Business Profile, including:

• Connecting a Google Business Profile via Google OAuth
• Viewing and managing customer reviews
• AI-generated review reply suggestions (paid plan)
• Creating, scheduling, and publishing Google Posts
• AI-generated post content (paid plan)
• Automation settings for review replies and post scheduling (paid plan)
• Email notifications for new reviews and published posts (paid plan)

2. Eligibility and Account Registration

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use the Service. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

You are responsible for maintaining the security of your account credentials. You must not share your login credentials with any third party. You must notify us immediately at letsadvertize@gmail.com if you suspect unauthorised access to your account.

You may only create one account per person or business. Creating multiple accounts to circumvent plan limits or restrictions is prohibited.

3. Subscription Plans and Payment

Free Plan

The Free Plan is available at no cost and includes connecting one Google Business Profile, viewing reviews and posts, writing replies and posts manually, and publishing manually. AI features, scheduling, and automation are not included in the Free Plan.

GrowMyGMB AI — $9.99 / month

The paid plan includes all Free Plan features plus AI reply generation, AI post generation, post scheduling, automation rules, and email notifications. Subscription fees are billed monthly in advance via Stripe.

4. Google Business Profile — Your Responsibilities

By connecting your Google Business Profile, you authorise us to access and manage your profile on your behalf, including reading reviews, posting replies, creating and publishing posts, and managing profile information. You remain fully responsible for all activity on your Google Business Profile.

You must ensure that your use of GrowMyGMB complies with Google's Business Profile Policies and Google's Prohibited and Restricted Content policies.

Agency users:If you are using GrowMyGMB to manage Google Business Profiles on behalf of your clients, you represent that you have explicit written authorisation from each business owner. You are responsible for obtaining and maintaining this authorisation and for ensuring that all activity complies with Google's policies. You must relinquish access within seven business days when a client relationship ends.

5. AI-Generated Content

GrowMyGMB uses Google Gemini AI to generate suggested review replies and Google Post drafts. All AI-generated content is provided as a starting point for your review and is not guaranteed to be accurate, appropriate, or complete.

• You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published.
• We make no warranty that AI-generated content will be factually accurate or suitable for your business.
• You retain full ownership of any content you publish to your Google Business Profile.
• We make no claim of ownership over content you create or publish through the Service.

You must not use AI features to generate false or misleading reviews, fabricated review responses, defamatory content, or content that violates Google's Prohibited Content policies.

6. Acceptable Use

You must not use the Service to:

• Violate any applicable laws or regulations
• Infringe any intellectual property rights of any third party
• Generate or publish fake, fabricated, or deceptive review content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Scrape, crawl, or use automated tools to extract data from the Service
• Attempt to gain unauthorised access to any part of the Service or any connected systems
• Interfere with or disrupt the integrity or performance of the Service
• Resell or sublicense the Service without our prior written consent
• Use the Service in any way that violates Google's API Policies or Business Profile Policies

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Let's Advertize and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service solely for your internal business purposes in accordance with these Terms.

You retain all rights to your business data, review content, and any content you create or publish through the Service. By using the Service, you grant us a limited licence to process your data as necessary to provide the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any errors will be corrected. We are not responsible for the availability, accuracy, or policies of Google Business Profile, the Google My Business API, or any third-party service.

Google may modify, restrict, or discontinue its APIs or Business Profile features at any time. We will make reasonable efforts to adapt the Service accordingly but cannot guarantee continued functionality.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) $100 / £100 (AS APPLICABLE TO YOUR JURISDICTION).

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify and hold harmless Let's Advertize and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content you publish to your Google Business Profile; (c) your violation of these Terms; or (d) your violation of any third-party rights, including Google's API Policies.

11. Termination

By you: You may cancel your subscription and close your account at any time from the Billing page. Cancellation takes effect at the end of the current billing period.

By us:We may suspend or terminate your access to the Service immediately and without notice if you: violate these Terms; violate Google's API Policies; engage in fraud or misrepresentation; or if required by law. For less serious breaches, we will provide 30 days' written notice and an opportunity to cure before termination.

Upon termination, your right to use the Service ends. We will retain your data in accordance with our Privacy Policy and applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that nothing in this clause limits your statutory rights as a consumer in your country of residence.

If you are a consumer located in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you may cancel your account before the changes take effect.
